Family Sues Moody Gardens for $1 Million After Child’s Drowning
Moody Gardens is being sued for wrongful de@th by Matthew Raybrun, the father of a 4-year-old kid who drowned in the hotel pool on July 1. Asher Rayburn’s body was discovered at the bottom of the hotel pool later that day, and the complaint alleges that his de@th was the consequence of the hotel’s “gross negligence.”
Witnesses reportedly rescued the toddler from the pool at around 9:30 p.m. and administered CPR until paramedics arrived. He was rushed to UTMB, but he was pronounced de@d there the following morning, a few days before his fifth birthday. Asher and his parents were visitors from Paris, Texas, celebrating his birthday.
The lawsuit claims that no one from the hotel was watching the pool when the child drowned and that it is unknown how long the child was submerged before being discovered.

The lawsuit alleges multiple wrongdoings on the part of the hotel, including a failure to properly supervise the pool and provide the necessary training for staff, a delay in responding to the situation, and a lack of adequate safety measures. Asher’s dad wants $1,000,000 in damages.
Although Moody Gardens has not issued a formal response to the lawsuit, a statement was released shortly after the incident.
“The management and staff at Moody Gardens are devastated by this tragic event and have been working with the authorities as they conduct their investigation to understand the circumstances that led to this incident.
